If you do not agree to these terms, please do not use our Site or engage our services.
These Terms and Conditions apply to all visitors to the Site and to all Clients who request or receive services from WD Richmond Fence Builder. We reserve the right to update these terms at any time. Changes take effect when posted to this page with a revised effective date.
WD Richmond Fence Builder provides residential and commercial fence installation, repair, replacement, and related services in Richmond, California and surrounding service areas. Our services include, but are not limited to, wood fence installation, vinyl fence installation, chain link fencing, aluminum fencing, ornamental iron fencing, privacy fencing, pool fencing, gate installation, and fence staining and sealing.
We reserve the right to decline any project at our discretion, including projects that fall outside our service area, exceed our current capacity, or present safety concerns.
All written estimates provided by WD Richmond Fence Builder are based on the scope of work described at the time of the site visit or inquiry. Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.
An estimate does not constitute a binding contract until both parties have signed a written service agreement or work order. Final pricing is subject to change if the scope of work changes, unforeseen site conditions are discovered (such as buried debris, unmarked utilities, or property encroachments), or material costs change significantly between the estimate date and the start of work.
We will notify you in writing of any scope or cost change before proceeding with additional work. You are not obligated to proceed with any change that has not been approved in writing.
Project start dates are estimates and are subject to change due to weather, material availability, permit processing times, and scheduling dependencies. We will make reasonable efforts to notify you promptly of any schedule changes.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible by phone or email. Projects cancelled after materials have been ordered or permits have been pulled may be subject to restocking fees and permit fees actually incurred by us on your behalf.
We reserve the right to reschedule or pause work due to unsafe weather conditions, including high winds, heavy rain, or other conditions that pose a risk to workers or the quality of the installation.
Payment terms are specified in your written service agreement or work order. In general, a deposit may be required before work begins, with the remaining balance due upon project completion unless other terms are agreed upon in writing.
Accepted payment methods will be specified in your service agreement. Payments not received within the agreed timeframe may be subject to a late fee. Unpaid balances that require collection efforts may result in the Client being responsible for reasonable collection costs, including attorney fees, to the extent permitted by applicable law.
Title to and risk of loss for any materials installed on your property passes to you upon full payment of the agreed project total.
Where required, WD Richmond Fence Builder will apply for and obtain necessary building permits on behalf of the Client. Permit fees are the Client's responsibility and will be included in the project estimate. The Client is responsible for ensuring that the project site is accessible and that any HOA approval or neighbor notification required by law is obtained before work begins.
We install fences in compliance with applicable local building codes and regulations at the time of installation. We are not responsible for changes in local ordinances, HOA rules, or property line determinations that occur after installation is complete.
We stand behind the quality of our workmanship. Any warranty terms specific to your project will be stated in your written service agreement.
Manufacturer warranties on materials (such as vinyl fence panels, aluminum components, or hardware) are passed through to the Client to the extent permitted by the manufacturer. We do not control manufacturer warranty terms and make no additional representations regarding material longevity beyond what is stated in your service agreement.
Our workmanship warranty does not cover damage caused by acts of nature (including but not limited to storms, flooding, or earthquakes), vehicle impact, vandalism, improper maintenance by the Client, or modifications made to the fence by anyone other than WD Richmond Fence Builder after installation.
Except as expressly stated in your written service agreement, all services are provided "as is" and we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, WD Richmond Fence Builder shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services provided or the use of this Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a service engagement shall not exceed the total amount you paid us for the specific project giving rise to the claim.
We are not liable for damage to underground utilities, irrigation lines, or other subsurface installations that were not identified or marked before work began. It is the Client's responsibility to notify us of known underground features and to arrange for utility marking through California 811 prior to any digging.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from these terms or from services provided by WD Richmond Fence Builder shall be brought exclusively in a court of competent jurisdiction located in Contra Costa County, California.
We may modify these Terms and Conditions at any time. Updated terms will be posted to this page with a revised effective date. Your continued use of the Site or engagement of our services after any modification constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
